Plaintiff was a kind elderly woman who lived by herself in another state. While visiting her daughter’s home in St. Louis for Christmas, she suffered a fall and broke her left hip and left arm. She had surgery at a St. Louis County hospital to repair her broken left hip. She went to a nursing home for rehabilitation and had to be lifted out of bed with a hoyer lift. Shortly after her arrival employees were trying to use the lift to get her out of bed, but failed to fully extend the legs of the lift because they didn’t know how to use it. The lift tipped over causing the resident to fall to the floor and breaking her right hip. She ended up having to have surgery on her right hip and was forced to recuperate two broken hips at the same time. She was never able to return to her home and lived the remaining years of her life in a nursing home.
